If the parties are unable to resolve a dispute through negotiation within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). The arbitration shall be conducted in Metro Manila, Philippines, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties.

Notwithstanding the foregoing, php878 reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.

12. Severability and Waiver
